Section 125
No gambling or betting

(1) No person shall play or gamble.
(2) A person who commits an offense under sub-section (1) shall be punished as follows:-
(a) Imprisonment for a term which may extend to three months or fine which may extend to thirty thousand rupees, for a person who gambles or gambles for the first time,
(b) Whoever gambles or gambles for the second time shall be imprisoned up to one year and fined up to fifty thousand rupees, and for the subsequent offence, imprisoned up to three months and fined up to ten thousand rupees.
(3) "Gambling" means any kind of game or process of betting on winning or losing any movable or immovable property or reward on the basis of any chance, and by that word, one does not gamble, and one's own movable or immovable property depends on the loss or victory of others. It also refers to a bet or wager made to gain or lose property or rewards. But none of the following games or events shall be considered gambling:-
(a) Games conducted with the approval of the Government of Nepal for the purpose of gaining or losing any small movable property for entertainment at any public festival, fair, festival, festival, exhibition or ceremony,
(b) Lottery conducted with the approval of the authorized officer.
(4) "Gambler" means a person who gambles by knowingly providing a house, room, place or vehicle in his right, enjoyment, custom, ownership or charge or by providing any kind of means for gambling.
(5) Gambling tools and all movable and immovable property obtained from gambling will be confiscated. However, the house, room, place or vehicle used for gambling will not be confiscated.
(6) No one shall make or cause to bet.
(7) For the purpose of sub-section (4), a person shall be deemed to have committed an offense of betting if he places a bet to gain or lose any movable or immovable property or reward if a particular party loses or wins in any game or process to be played in accordance with the law.
(8) If there is an offense under sub-section (4), the person who commits the offense shall be imprisoned for one year and fined up to ten thousand rupees. (9) Punishment for an offense under this section shall be imposed on the basis of conviction by the court.
